Affidavit of Income and Expense:
During an emotionally charged divorce, people are often ill-equipped to prepare an affidavit to prove to the court how much they need to maintain their life style. We can help you document an annual income and expense affidavit that duplicates the court affidavit format. Following an income and expense analysis, we make a recommendation for temporary support that recognizes the limited funds available and the added expense of two households.
In some instances, this leads to an agreed order, thus avoiding a trial. When a compromise can not be reached, we produce a detailed report with a one-page summary of the analysis illustrating the income available, past spending, and current needs.
Tax and Cash Flow Analysis:
To illustrate the after-tax cash available to each spouse, post divorce, at different child support and maintenance levels, we use Divorce Planner software, developed by FinPlan. In comparing alimony/child support alternatives and the resulting tax consequences, cash flow projections are calculated for both parties. These projections provide side by side comparisons of income, Federal, State and FICA taxes, and the resulting cash available to meet budgets.
Child support is automatically computed per the guidelines. Combining the detailed cash flow analysis of Quicken and the projections of Divorce Planner will aid both spouses in a divorce to understand the impact of available income, budget needs, and the tax consequences of different options. These reports are extremely effective whether mediating, negotiating or litigating a case.
